Is this sickness policy fair?

Okay, so I’ve been in my new job a few weeks so I’m not eligable for sick pay yet (fair enough). But last night I was working night shift and I was due to finish at 7am. However I was coming down with conjuctivitis and by 5am my right eye was so swollen and gunky that I said to the boss I was going to have to go home, if that was okay, because it was getting worse (despite rinsing with eye drops and that) and that I felt that in 2 hours time I wouldn’t be able to safely drive home. I work for the council in the CCTV room (I operate CCTV cameras). Anyway, she said (rather blunty) that it would go in as a whole shift’s sick, even though I’d been there 8 hours and was only missing 2 hours. As it was bank holiday, I am now losing out on 10 hours pay, which from clocking on last night til midnight was double time (as it was a bank holiday) and I also get those hours back in leiu (sp?). So basically I’ve lost my double time, TOIL and the rest of the shift’s pay because I missed 2 hours! Is that fair? Can they take all that off me and put down in my record that I missed a whole shift when really I only missed 2 hours. It just seems a bit unfair, especially since I had no choice but to go; it wouldn’t have been safe for me to drive home. :-(
To add – kleighs mommy – the condition developed whilst I was on shift, I wouldn’t have gone to work had I already had it!
I just think it’s downright unfair, I really considered staying because I need the money so badly (I barely get paid enough anyway) but I would never have forgiven myself if something had happened on the way home.

Also, I couldn’t have got a taxi etc. as it have meant leaving my car at work (not an option, not allowed!) as there wouldn’t be anyone to drive it home.

    that doesn’t seem right as it will leave you financially worse off

    check directly with the personnel department. it should be written into their policy

    and if this is correct ask who would be responsible if you had an accident on the way home . also i would check the cut off time , would it have happened if you left 5 minutes before your shift ended ?

    last bit of advice – join a union

    its so crap. i work for virgin media and over the summer i was working 9-5 doing training and had severe cystitis and was in agony, i sufffered it till 2.30ish and asked if i could go home, and the trainer said "yes sure but it’l go down as an unpaid absence for the whole day"

    i think its so unfair. you did the hours, you should get the money!!! :@

    That is totally unfair as you had worked 8 hours, id go above your bosses head or the personnel department, you should get paid for this!!

    yes they can

    you shouldnt have been there period you have a highly contagious eye infection

    you should have called out and went to the doctor and been put on antibiotics you cant clear that up with over the counter eye drops

    stay away from work and get it treated properly

    You are entitled to be paid for the hours you worked including bonuses. If you work for the council you need to contact the human resources department for clarification of their policies so you can set your supervisor clear.

    Its not fair but it’s probably out of your boss’s hands, its a rule made up by some idiot in head office, get in contact with them

    Is there someone higher up that you could discuss the matter with (human resources maybe). Personally that does not sound legal or ethical to me. I would not let it go if I were you, unless you feel it may make your working environment uncomfortable as your boss may hold a grudge.

    Now, I am not sure where you live but it seems highly illegal to me for you to not be paid the hours you worked.

    I could see perhaps, that if the hours you didn’t work put you into a part time bracket or something that excluded you get the stat (bank) day, but not right out cutting your 8 hours on earned wages!

    Yahoo search your state and employment standard or labor relations. You might be able to find the laws online, or at the very least a phone # to a department that can advise you of your rights.

    If your attendance record has been good so far and you arrive for work on time, you should take this up with your boss. Have you "blotted your copy book" or is she just a b1ith?. Compose a letter outlining your grievances and ask her for a private chat, either before or after your shift starts or in your tea break. You could even offer to go in on your day off for the private chat. (Crawl) When you have your private chat, tell her that you are aware of most of the rules and that you were not aware of how two hours off would effect your pay. Ask her if she is happy with your work and if you have done anything in the past to upset her. Whatever you do "don’t stand on your high horse". If she does not recognise how unfair that this is, tell her that you intend to send your letter to whoever is responsible for monitoring the "time sheets" and your wages. Give her a copy of the letter and try to part on amicable terms.

    Call corprate and report boss he seems like she was forcingyou to stay so she would not have extra weork for her I bt she has you do 1/2 her work? do you have proof of time spent that is totaly against labor laws union or not go up the food chain until somebody listens call the local court for advice on how to report labor laws ask if legal you did work and are human

    If you are a member of a union I would get in touch and let them take up your case. If not, I would see a solicitor because I would hazard a guess and say that this Gestapo type boss is making the rules up to suit herself and in this day and age is probably breaking the law.

    Join a union.
